General Terms and Conditions of Participation for Competitions and Contests of Yoummday GmbH (valid since November 2025)

1. Organizer

The organizer is Yoummday GmbH, Infanteriestraße 11a, 80797 Munich, Germany (hereinafter referred to as the “Organizer”).

2. General Conditions of Participation

Participation in competitions or contests held by the Organizer is subject to the following conditions:

2.1 Eligibility

Eligible to participate are:

• • Only natural persons aged 18 or older
  • Employees of Yoummday GmbH and their relatives are excluded from participation

2.2 Exclusion from the Competition

The Organizer reserves the right to exclude participants from the competition if there are justified reasons, particularly in cases of violations of the participation conditions, manipulation, or the provision of false information.

2.3 Data Protection

Personal data transmitted in the context of participation is processed exclusively for the execution of the competition. For more information, please refer to the Organizer’s “Data Protection Notice for Participation in the Instagram Advent Calendar 2025.

3. Copyright and Usage Rights

3.1 Submitted Content

By participating, you confirm that all content submitted by you—such as comments, responses, images, or videos—was created by you and does not infringe any third-party rights. You affirm that you are the sole copyright holder and that no third-party brands,

individuals, or protected elements are shown without permission. The Organizer assumes no responsibility for any legal violations arising from submitted content.

3.2 Use of Submitted Content

By participating, you grant the Organizer permission to use your submitted content in connection with the competition. This includes displaying the content under the competition post, presenting it in the winner announcement, and using it for communication related to the competition. Use is limited exclusively to this direct context.

4. Liability Disclaimer

The Organizer is not liable for technical disruptions, data loss, or access issues that occur during the submission or processing of entries, unless caused by gross negligence or intent.

5. Final Provisions

The Organizer reserves the right to terminate or modify the competition in full or in part for important reasons (e.g., technical problems, legal changes).

The place of jurisdiction is Munich, Germany. The law of the Federal Republic of Germany applies.
