Specific Terms for the “Instagram Advent Calendar Giveaways 2025”

1. Subject of the Competition

The Organizer is conducting a giveaway on Instagram, where participants have the chance to win:

• a yoummday Surprise Box,

• money credited directly to their yoummday account, or

• a “Digital Planner” bundle.

The competition serves exclusively promotional purposes on Instagram and is in no way affiliated with Instagram itself.

2. Competition Period and Process

Giveaway 1:

· Participation period: 03.12.2025 – 05.12.2025 at 23:59

· Contacting selected winners: no later than 31.12.2025

· Response deadline: within two (2) weeks after being contacted, but no later than 18.01.2026

Giveaway 2:

· Participation period: 16.12.2025 – 18.12.2025 at 23:29

· Contacting selected winners: no later than 31.12.2025

· Response deadline: within two (2) weeks after being contacted, but no later than 18.01.2026

3. Participation Requirements and Submissions

Participants must:

Giveaway 1:

· “Share a picture of your winter home office setup or your favorite Christmas sweater in your Instagram Story and tag us (@yoummday_com).”

· “Your profile must be public for this. If you prefer not to make it public, please send us a screenshot of the Story with the tag.”

Giveaway 2

· Follow us, like the post “Giveaway II” from 16.12.2025, and tag two friends

· Participation occurs exclusively via the Instagram account @yoummday_com

4. Selection and Prizes

Winners will be notified via Instagram Direct Message within 14 days after the giveaway ends. If no response is received within 7 days, the prize will be reallocated.

1st place: yoummday Surprise Box 2nd place: €75 credit to the yoummday account 3rd place: “Digital Planner” bundle 4th place: “Digital Planner” bundle 5th place: “Digital Planner” bundle

Giveaway 2:

5. Data Protection

By participating in the giveaway, you agree that your Instagram username may be published in our Instagram Story if you are one of the winners.

This mention is exclusively for announcing the winners.

After announcing the winners, we will contact you via Instagram Direct Message to clarify the next steps.

If we need additional information to send your prize, you agree that we may use the data you voluntarily provide.

This may include your full name, e-mail address, or additional contact details.

If your prize is a credit to your yoummday account, you agree that we may use the necessary information from your Talent Profile — including your name, Talent ID, and the profile details required to issue the credit.

This data is used solely for processing the prize.

All data you provide to us in the context of the giveaway will be used exclusively for the execution and handling of the competition and will be deleted thereafter, unless statutory retention periods apply.

Legal recourse is excluded.

III) Type and Scope of Processing

We process the following personal data from you:

· First and last name

· Talent ID and your talent profile

· E-mail address

· Address

· Instagram username

IV) Purposes and Legal Bases of Processing

Your personal data is processed in order to send you the prize or to transfer it to your yoummday account.

Specifically, this means:

· If you are selected as a winner, we will contact you via Instagram message. Depending on the prize you’ve won, we may ask you for your e-mail address, your Talent ID, or your postal address.

· Only the data necessary for delivering the prize will be used.

· Your Instagram username will be publicly shared in our Instagram Story or under the giveaway post as part of the winner announcement.

We process your data based on your consent pursuant to Art. 6(1)(a) GDPR, which you provide by interacting with the posts (sharing or commenting). Your rights relating to data processing are described in detail in section VII.

V) Recipients or Categories of Recipients and Third-Country Transfers

Within our company, only departments that require your data for the purposes described in section IV receive access. These include primarily:

In addition, we use external service providers for publication.

We have concluded data processing agreements with all service providers in accordance with Art. 28 GDPR. If data is transferred to a third country, we implement additional safeguards under Art. 44 et seq. GDPR (e.g., Standard Contractual Clauses).

Please note that publication on the internet may result in the content being accessible in third countries.

VI) Storage Period

Data will be deleted once it is no longer required for the purposes described above (sending the prizes), but no later than 12 months after collection.

If you withdraw your consent, we will delete the affected data immediately upon receiving your withdrawal.

VII) Your Rights

You may exercise your rights under Articles 15–21 GDPR at any time.

Right of Access – Art. 15 GDPR

You have the right to request confirmation as to whether your personal data is being processed. If that is the case, you have the right to access this personal data in accordance with Article 15 GDPR.

Right to Rectification – Art. 16 GDPR

You have the right to request the immediate correction of inaccurate personal data concerning you. Taking into account the purposes of the processing, you also have the right to request the completion of incomplete personal data — including by means of a supplementary statement.

You have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used, and machine-readable format. You also have the right to transmit this data to another controller without hindrance from the controller to whom the data was originally provided, where Article 20(1)(a) or (b) GDPR applies.

Right to Lodge a Complaint with a Supervisory Authority – Art. 77 GDPR

You also have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data is unlawful. This right exists without prejudice to any other administrative or judicial remedy.
